Why is it Important? |
Employers must be aware of the Americans with Disabilities Act (ADA) and cannot discriminate in hiring based on disabilities. A worker’s compensation search will allow an employer to comply with the ADA after making a job offer. |

Notes about this Information |
Applicants that have filed valid workers’ compensation claims are protected against hiring discrimination by the ADA. Further, if an applicant has a disability but is still able to perform essential job functions, the ADA provides protection against discrimination. Before an employer requests or uses workers’ compensation records, they should implement policies and procedures governing the use of such records. |
